ACCOMPLISHMENTS

David’s major matters include:

• Acting in a proceeding resulting in the leading High Court of Australia decision on vicarious liability, successfully challenging the decision of the Supreme Court of Victoria in confining the scope of vicarious liability to being imposed strictly in the circumstances where an employment relationship existed
• Defence of an appeal on quantum in the Supreme Court of Victoria. Successfully upholding the decision at first instance  in respect of not relying on average weekly earnings, in determining an individual’s loss, before they attained the age of 18, over a period exceeding 4 decades
• Obtaining majority contribution from a third party, in a non-litigated institutional liability matter, achieving a resolution that reduced his client’s exposure to under 20%
• Autonomous management of a national portfolio of over 200 claims, pro-actively reducing exposure.
