Jonathan has specialised in insurance litigation since his admission to practise in 2019. He regularly acts for insurance organisations and local government agencies in a range of public liability and property damage matters, including personal injury, marine insurance, common law and VWA recovery claims.
He regularly represents clients at mediations and settlement conferences, appears at interlocutory hearings and instructs counsel at County and Supreme Court trials.
Jonathan completed a secondment with a national insurer in 2022 in their Marine Specialty Risks team, managing marine cargo, hull and freight forwarder liability claims as well as providing indemnity advice.
Jonathan previously worked as a lawyer and represented national insurers, underwriting agencies and mutuals in motor vehicle and property damage disputes, handling a large variety of litigated subrogated recovery and defendant claims.
ACCOMPLISHMENTS
Jonathan was involved in the Court of Appeal decision of Citywide Service Solutions Pty Ltd v Rosata; Kabbout v Crown Melbourne Ltd [2023] VSCA 281 and High Court decision of Rosata v Citywide Service Solutions Pty Ltd & Anor [2024] HCASL 106. The decisions set a precedent with respect to the proper construction of s.28LZH of the Wrongs Act 1958 (Vic) and that in practice, a later joined defendant to a proceeding is not bound by an earlier Medical Panel determination. Jonathan’s client was successful at the Supreme Court of Appeal and at resisting the application for special leave in the High Court.
