David has extensive experience in litigation and dispute resolution across all Australian jurisdictions, including the High Court of Australia. With a consistent track record of defending non litigated matters and litigated matters in Court, David has successfully acted in claims made against insurers, self-insurers, non-government organisations, not-for-profit organisations, schools, fraternities and private clients.

Since 2016, David has acted for defendants across the broad spectrum of personal injury and damages claims, including psychical injuries and psych injuries.

In acting for his clients, David engages in a collaborative yet inquisitive approach, to fully address all apparent and latent issues presented by each individual matter, in a manner that is consistent with his clients’ requirements. ACCOMPLISHMENTS

David’s major matters include:

  • Acting in a leading High Court of Australia decision on vicarious liability, successfully challenging the decision of the Supreme Court of Victoria in confining the scope of vicarious liability to being imposed strictly in the circumstances where an employment relationship existed
  • Defence of an Appeal on quantum, in the Supreme Court of Victoria. Successfully upholding the primary Court’s findings in not relying average weekly earnings, in determining an individual’s loss, before they attained the age of 18, over a period exceeding 4 decades.
  • Obtaining majority contribution from a third party, in a non-litigated institutional risk matter, achieving a resolution that reduced his client’s exposure to under 20%
  • Autonomous management of a national portfolio of over 200 claims pro-actively reducing exposure
  • Obtaining majority contribution from an employer, in a matter concerning an accident at a building site, with no possibility of recovery by the Victorian Workers Authority
  • Successfully obtaining a re-assessment that reversed initial findings of an injured person having attained a whole person injury satisfying the threshold for an entitlement of General Damages.
