EXPERIENCE & EXPERTISE
Rachel is a senior lawyer with a varied and successful career working in the Commonwealth and State Workers’ Compensation jurisdictions. She has practised as both a barrister and solicitor acting for injured persons, employers, self-insurers, government, and claims agents. She was the founding principal of her own law firm, Cubela & Co, before joining Moray & Agnew.
Rachel also has extensive government and administrative law experience from her time at WorkSafe Victoria as a Director and in private practice, and as the former Secretariat of the Heads of Workers’ Compensation Authorities in Australia and New Zealand. This includes advising on proposed legislative changes, scheme significant matters, statutory interpretation, policy and procedure, providing operational and strategic advice, chairing committees, responding to Ministerial queries and correspondence, whistle-blower complaints, and liaising with stakeholders.
Rachel was seconded to EML in 2015 as Acting Legal Specialist, Victorian branch to advise and receive instructions on Victorian common law claims in a peer to peer review format with a large supermarket and their panel firms. Following that secondment, Rachel was approached and became the Senior Legal Manager for EML Victoria and Executive Leadership Team member in 2016. Between 2018-2024, Rachel was self-employed, acting for and advising employers and self-insurers on all aspects of workers compensation and occupational health and safety matters.
