Anna has strong experience in professional liability, health law, consumer law, general liability, and commercial litigation matters. She has acted in matters in the Supreme, District, Coroner’s and Magistrates Courts and the State Administrative Tribunal.
Throughout her career Anna has had broad exposure to a range of insurance products and claims. Accordingly, Anna has developed strong experience considering and interpreting policy documents in order to determine indemnity issues at the outset, often saving her clients time and costs.
Anna recognises that clear communication with insurers and insureds is fundamental to the successful and timely management of claims. She understands the value of efficient claims management and is able to readily discern the matters in issue between parties in order to explore possibilities for resolution at the earliest opportunity. Her broad based experience enables her to provide clear, practical and realistic advice while her claims management strategy focuses on the early identification of issues and risks, with the view to prompt resolution of claims where there is clear exposure. Anna will recommend fully defending matters to trial when it is appropriate to do so.
Anna understands the importance of developing a claims management strategy and regularly updating and reviewing the strategy as new information and evidence comes to light. Anna also recognises the importance of ensuring that, wherever possible, adequate costs protection is obtained by making early offers in circumstances where there is a risk of liability being established.
Anna has developed good relationships with colleagues in the industry, enabling her to engage in with key stakeholders in a pragmatic and respectful way in order to achieve the best outcome for her clients. Her preparedness to always discuss claims directly results in a far less adversarial environment, which ultimately benefits her clients.
ACCOMPLISHMENTS
In 2012, Anna was an inaugural member of the Western Australian branch of the Young Insurance Professionals. She subsequently acted as the Western Australia Vice President (2016), Western Australian President (2016 - 2019) and National Vice President (2019).
In her various roles Anna has been a strong advocate for the insurance industry including through engagement with new entrants and educational events. Anna has provided in-house training to both clients and colleagues on a range of legal topics and is always willing to provide training to clients on request.
Anna’s strong understanding of the Australian Consumer Law (as scheduled to the Competition and Consumer Act 2010 (Cth) sets her apart from others. In particular, her knowledge of the product safety regime enforced by the Australian Competition and Consumer Commission enables her to provide timely, accurate and succinct advice to her clients to ensure compliance.
Anna was involved in the implementation of a claims management process with an international insurer in respect of a product liability matter, whereby Moray & Agnew were authorised to resolve a category of claims up to a specified sum. This process proved to be a timely and cost effective way of managing claims.
